Notifying three residential and agricultural structure with stop work in Tubas

 

Violation: stop work orders served on three Bedouin families

Date: 26/11/2013

Location: al-Farisya and al-Ras al-Ahmar

Perpetrators: the Planning Committee of the Civil Administration

Details:

On November 26th 2013, the so-called Planning Committee of the Civil Administration served three stop work orders on agricultural and residential structures owned by three Bedouin families in the area of northern Ghoor; the Palestinian Jordan Valley. This came under the pretext of unlicensed construction within area classified C according to Oslo Accords.

It should be marked that the notified families in Khirbet al-Farisya and Ras al-Ahmar live in houses made of cloth and wood where their barns( for sheep husbandry) were built by metal slabs. Those two Khirbets are administratively relative to the village council of  "al-Maleh and the Bedouin communities". The chairman of the village council Aref Daraghmeh to the LRC researcher stated that : " there are several targeting attempts on the Bedouin communities in the area of al-Ghoor where the occupation has been trying to change facts on the ground and to displace indigenous in all possible means. It is worth mentioning that the notified families residing the area have been living there for decades and have taken sheep herding as their profession. The following table shows information about the notified families :

About al-Farisya:

The Khirbet is located 17km from northeast of Tubas. It is surrounded by Tal el-Jamih frim the north, Tubas from the west, Shadmot Mehola colony from the east, and Rotem colony and al-Malih from the south.

It has a total population of 200 people according to the census of 2007. The area is relative to Ein al-Baeda and it has a built-up area of 5 dunum. Noteworthy, the bypass road no. 578 routes nearby al-Farisya.

It is indicated that the occupation worked hard to displace residents of this Khirbet by issuing stop work and demolition orders by the Planning Committee of the Civil Administration. Noteworthy, the occupation demolished the Khirbet three times during the past couple of years which resulted in displacing many people and causing many losses and damage. Despite all that , residents insist on staying there for they have no other place to go to .

About Khirbet al-Ras al-Ahmar:

It is located in the area of Sahel al-Bqai'a, east of Tammun village. The residents of the Khirbet have roots originally from Tammun and more specifically, the families of Bsharat and Bani Oudeh. Ras al-Ahmar has a total population of 260 people according to the data of the village council. It should be marked that 80% of the residential tents and sheep barns in the Khirbet are notified with stop work by the Planning Committee of the Civil Administration. As a result , 13 structures were demolished during the past two years under the pretext of unlicensed construction.

Conclusion:

What the area of Wadi al-Maleh and Khirbets relative to it has been going through is a concrete violation of Geneva fourth Convention and a violation of the Hague Convention that mentioned  the right to housing and the right to using lands as well.

Land Research Center supports these people to stay on their lands and call on the international human rights organizations to intervene to stop violations and reimburse the affected.
