Halt of Work Orders on Facilities in An-Nabi Elyas Village/ Qalqilya Governorate

Description:

Wednesday noon, the Israeli occupation forces accompanied by an officer from the building and organizing commission raided An-Nabi Elyas village east Qalqilya , the troops served halt of work military orders to an automobile workshop , in addition to an agricultural room built of bricks and cement.

According to the military orders, 8^th of July will be the date of the subcommittee session in Beit El court to decide the fate of the structures.

Salah Nazzal, one of the affected told LRC reporter:

“The occupation has been escalating building restrictions in the village since opening the new segment of bypass 55. Nowadays, only the eastern area of the village is available for expansion , but still the occupation is imposing restrictions on building on it.

 In the recent two months, the occupation troops demolished agricultural structures in the village. And today the occupation forces target my workshop, ignoring the fact that it is the only source of income for the family. Once we received the military order, we headed to the legal department in Qalqilya , and served the legal documents that prove we own the land , hopefully that will rescue our source of living. Knowingly, the occupation rarely license Palestinian structures.”

Noteworthy, An-Nabi Elyas – like other Palestinian communities- was and still a hot spot for Israeli human rights violations. The occupation imposes a small built-up area, which pushed residents to build outside the organizational plan , and become exposed to the Israeli arbitrary measurements. Reportedly, there are at least 23 threatened facilities in An-Nabi Elyas due to licensing issues.

About Nabi Elyas:

It is located 6km to the east of Qalqiliya governorate and is edged by Izbbet Al-Tabib and Aslah villages from the east, Arab Abu Fardeh area from the west, Jayyous town from the north and Ras Tayreh from the south.

The village populates 1399 inhabitants (2017 census) that are relative to three main families namely ( Hannun, Khleif and Majd)

Nabi Elyas has a total area of 4435 dunums, of which 123 dunums are considered the village’s built-up area. Noteworthy, more than 2200 dunums of the area were isolated behind the apartheid wall and became subject to colonial activities of takeover and expansion.

International Conventions and agreements pertaining to house and residents demolition:

• Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)
• Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
• Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.
• Article 32 of Hague convention 1907 part g: To destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war.
• Article 17 of Universal declaration of human rights 10 –Dec- 1948:  No one shall be arbitrarily deprived of his property.
