Violation: destroying sheep barns
Location: Yatta/ Hebron governorate
Date: 03/08/2015
Perpetrators: the Civil Administration of the Israeli occupation CA
Victims: citizens Ammar and Ali Hathalin
Details:
The Israeli occupation authorities on August 03, 20115 demolished sheep barns owned by citizens Ammar and Ali Hathalin from the area of Khashem ed-Daraj, southeast of Yatta in Hebron governorate.
Citizen Ammar Hathalin asserted that a force of the occupation army and the Civil Administration accompanied by a JCB dozer in addition to Borders Police raided the eastern side of village and embarked on demolishing the barns.
The demolished structures are reported to be built in mid sixties; rocks and stones were used to build the structures, Hathalin said. Ammar and Ali seasonally reside in the area; especially during spring. The two residents set up their tents nearby the sheep barns until spring is over, which is when they leave to find new pastures.

Hathalin said that the Israeli occupation authorities in 2011 delivered him an eviction order under the claim of the land being “state property”. After preparing a master plan for the village of Kashem ed-Daraj, the barns stayed out of it and got demolished by the occupation as a result.
The demolished structures were reported as follows:
- The sheep barn of Ammar Hathalin: it is of 200m2 in area and accommodates 150 sheep
- The sheep barn of Ali Hathalin: it is of 250m2 and accommodates 200 sheep
As a result, the place became hard to live in after getting the two barns demolished
It should be marked that the Israeli occupation authorities carried out many demolitions during the past; Land Research Center documented the attacks as follows:
- The Israeli occupation demolishes structures in Yatta town (Ar, Eng)
- The Israeli occupation demolishes agricultural structures and residences in Yatta town(Ar, Eng)
- The Israeli occupation demolishes 14 water wells in Yatta town (Ar, Eng)
Land Research Center LRC sees that demolitions contradict with all the International conventions and Humanitarian laws including:
Article 17 of the (1948) Universal Declaration of Human Rights stating: “Everyone has the right to own property alone as well as in association with others. No one shall be arbitrarily deprived of his property.”
Section ‹G› of article 23 of the (1907) The Hague Conventions asserting: “In addition to the prohibitions provided by special Conventions, it is especially forbidden to destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.”
Article 53 of the Geneva Fourth Convention (1948) declaring: “Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.”
Section 1, Article 11 of the International Covenant on Economic, Social and Cultural Rights (1966): “The States Parties to the present Covenant recognize the right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and to the continuous improvement of living conditions. The States Parties will take appropriate steps to ensure the realization of this right, recognizing to this effect the essential importance of international co-operation based on free consent."
