Violation: destroying 24 different structures
Location: Bardala / Tubas governorate
Date: 04/11/2014
Perpetrators: the army of the Israeli occupation
Victims: 8 agricultural families
Details:
A massive force of the occupation accompanied by two bulldozers raided on Wednesday November 4th 2014 the area of Khallet al-Ghawanem, north of Bardala in Tubas.
It is indicated that the machineries embarked on demolishing 11 residential rooms ( made of wood and cloth shades) in addition to a residential container under the pretext of unlicensed construction within area classified C according to Oslo Accords.
A simple life hindered by the occupation :
It should be marked that the notified Palestinian families were previously served stop work orders in 2014. Licensing procedures were followed via the legal department of Tubas governorate and al-Quds Center for Legal Proceedings but despite completing all needed documents to obtain a permit , the Civil Administration of Israel rejected the authorization and demolished all structures in the area.
Noteworthy, the affected families from the last demolition fully depend on the agriculture sector as farmers. Farming is considered the main source of income where simple materials such like wood and cloth shades are how villagers build houses. Despite all, families have been living in the village for more than 30 years.
The chairman of Bardala Dirar Sawafta to the LRC researcher stated the following : "the latest demolition in Bardala is one of its kind , which the residents of Khallet al-Ghawanem underwent since 30 years. This dangerously indicates the expansion of Israeli violations and assaults in the area".
The following table shows information about the damages resulted by the demolition :

Land Research Center LRC sees that demolitions contradict with all the International conventions and Humanitarian laws including:
Article 17 of the (1948) Universal Declaration of Human Rights stating: “Everyone has the right to own property alone as well as in association with others. No one shall be arbitrarily deprived of his property.”
Section ‹G› of article 23 of the (1907) The Hague Conventions asserting: “In addition to the prohibitions provided by special Conventions, it is especially forbidden to destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.”
Article 53 of the Geneva Fourth Convention (1948) declaring: “Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.”
Section 1, Article 11 of the International Covenant on Economic, Social and Cultural Rights (1966): “The States Parties to the present Covenant recognize the right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and to the continuous improvement of living conditions. The States Parties will take appropriate steps to ensure the realization of this right, recognizing to this effect the essential importance of international co-operation based on free consent."
