Stop-work and demolition orders in the Hebron town of Idhna

Stop-work and demolition orders in the Hebron town of Idhna

  • Violation: serving stop-work and demolition orders
  • Location:  Idhna town- Hebron
  • Date:  October 31, 2016
  • Perpetrators: Israel Civil Administration
  • Victims:  citizens Mohammad Tomazi and Abdallah Masri

Details:

Israeli occupation authorities notified on October 31, 2016 structures of stop-work and demolition in Idhna town, west Hebron.

Residents of the area asserted that a vehicle relative to the so-called Israel Civil Administration accompanied by a Police patrol raided the area known as "Jurat Salem", hanged the orders on the targeted houses and took photographs of them before the force withdrew.

  1. Final stop-work and demolition order:

Citizen Mohammad Issa Tomazi received a final stop-work and demolition order on his house on the claim of "unlicensed construction" within area classified "C" according to Oslo Accords. Israeli occupation authorities requested a halt on construction works and the demolition of what has been so far built within a seven day deadline.

It should be marked that Israeli Occupation Forces served on July 21, 2016 a stop-work order on Tomzi's structure. At time, the citizen prepared the legal file to license his structure and object to the served order in Israel courts. Eventually, the occupation authorities served a final demolition order on the structure.

The 120m2 structure is reported built in 2015; it is supposed to be home for Tomazi's five member family including 3 children.

  1. Stop-Work order:

Citizen Abdallah Masri received a stop-work order on his house on the claim of unlicensed construction.

Israeli occupation authorities requested a halt on all construction works and assigned November 17, 2016 as the hearing session of the Inspection Sub-Committee of Israel Civil Administration in the Israeli court of Beit El colony to consider the status of the notified structure.

Israeli occupation authorities requested a halt on all construction works and assigned March 19, 2018 as the hearing session of the Inspection Sub-Committee of Israel Civil Administration in the Israeli court of Beit El colony to consider the status of the notified structure.

In reality, the issue is not all about unlicensed construction than it is on the occupation’s intention to take over more lands in the area of their control (Area C according to Oslo Accords). The Israeli occupation considers such lands as a colonial reserve, which will be hard to negotiate on in any future agreements with Palestinians.

2. Final stop-work and demolition order:

Citizen Mohammad Alaa Batran received a final stop-work and demolition order on his house foundation on the claim of "unlicensed construction" within area classified "C" according to Oslo Accords. Israeli occupation authorities requested a halt on construction works and the demolition of what has been so far built within a seven day deadline.

It should be marked that Israeli Occupation Forces served on November 30, 2017 a stop-work order on Batran's structure. At time, the citizen prepared the legal file to license his structure and object to the served order in Israel courts. Eventually, the occupation authorities served a final demolition order on the structure.

About Idhna:

It is 18km west of Hebron. According to statistics conducted in 2007, Idhna is inhabited by 19,012 people. It has a total area of 26,152 dunums, 2653of which are the village's built-up area.

The Israeli occupation confiscated 107 dunums of Idhna for the Apartheid Wall. Not only that, more than 3,511 dunums were isolated behind the wall as a result of its construction.

Besides, the bypass road number 35 -that is 4,674 meters long- confiscated more than 467 dunums from  the village lands.
