A six condo complex is to be demolished

 

Violation: Demolition order on a residential  complex in Ramallah

Details:

At noon of Tuesday July01, 2014, a massive force of the Israeli occupation, accompanied by members of the so-called Inspection Sub-Committee of the Civil Administration raided al-Bireh city, more specifically, Jabal Al Taweel (al Taweel mountain) area which is near "Pesagot"  colony, east of al-Bireh city.

It is marked that the occupation forces submitted a military order including "additional opportunity to object to a demolition order"  No. 305540 issued on October11, 2014 for the citizen Abaas Qar'an who is the son of the property owner. It is said that the deadline of the order is only after four days.

The occupation justified the issuance of the demolition order as "unlicensed" construction" in the area classified "C" according to Oslo Accords, taking into consideration that the residential complex is only 2km away from " Pesagot " colony.

The municipality of al-Bira objects against the Israeli order and asserts that the building is licensed and within areas "A":

It is marked and according to Hajj Fawwaz Qar'an,  the landlord of the building: "The complex consists of three floors and six apartments, and it was licensed from the municipality of al-Bireh with the blueprints certified from the regional planning committee of the Palestinian Authority in 2002, taking into consideration that the building is located in area classified "A" according to Oslo Accords."

The 74 year old Qar'an asserted to the LRC researcher: "The complex  was built in 1960 on a piece of land estimated to be 1.5 dunums in area and was originally composed of two condos, each of which is 128aqm in area . In 2002, a second floor of two condos was constructed and in 2003, another two-apartment floor  was  constructed to shelter my sons. I obtained the license of construction from the municipality of al-Bireh that was certified by regional planning committee of the Palestinian Authority, taking into consideration that the building is within area "A". Today,  I was surprised at receiving the demolition order on the building under the pretext of " unlicensed" construction within area "C".

Qar'an added: "The Israeli occupation alleges handing us stop work and demolition orders previously and that is what I vehemently negatesdenies since I have never received any notification in any possible way".

It should be mentioned that the citizens Ali Abdullah and Ahmad Qar'an  live in the united States of America and that the complex is only inhabited by the family of Abas Qar'an which consists of five member , three of whom are kids, and another rented condo by Ismael Al Nawabit.

Legal follow up :

It should be marked that the legal department in Ramallah and al-Bireh governorate  has formed, in coordination with the al-Quds center for legal pleadings,  a committee to follow up on  the case of the residential complex  in the so called Beit El court. Referring to al-Quds database, part of the building is indeed located within area "C" whereas most of the building is located within area "A"  according to Oslo Accords.
