Eviction and Demolition Orders Issued Against Two Palestinian Houses in Al Walajah
Violation: Demolition orders issued by Israeli occupation authorities.
Date of Violation: March 15th, 2010.

Type of Building: Two brick houses the area of each is 109 m2.
Owners: The brothers Ala’a Al Dien and Mohammad Salah Abdel Ghani Siyam and their 15-member families including 6 children.

Details:
Employees of the District Committee for Building and Planning in the Israeli Ministry on Interior were accompanied by members of the so-called Israeli Border Police when they placed the demolition orders on the two houses. The houses are owned by the brothers Ala’a and Mohamma1d Siyam in the neighborhood of Ein Jweiza in the village of Al Walajeh. The orders were issued using the usual pretext of “building without a permit.” The two brothers finished building their houses in January 2010 on an area of 0.5 dunums each. The surface area of each house is 109 m2. Ala’a family consists of 8 members of which 3 are children along with his mother. Mohammad’s family also consists of 8 members of which 3 are children.   
 
Mr. Ala’a expressed the following to Land Research Center (LRC)’s field researcher: ‘ My brother and I bought a 1-dunum piece of land in the area of Ein Jweiza. We opted to build our houses there as we have decided to stop renting houses. After we moved into the newly-established houses, the employees of the said Committee came to our houses and gave us Demolition Orders and threatened us that the demolition is going to take place in the near future. 
 
It is difficult to feel that one’s shelter is threatened and that he really does not own the land. We have built our houses to feel secure and safe, yet as long the occupation persists there is no safety. Our family feels that it is threatened each day and that tomorrow is bleak.’
 
The Two Decisions:
The District Committee issued the two Orders in Hebrew for the two brothers; the first one is a warning while the second one is an administrative demolition order. The first order read as follows:
 
Warning In Accordance with Article 238 of Building and Organization Law of 1965
 
I, the undersigned Daliet Zipler, in my capacity as a planner in the District Committee for Planning and Building in Jerusalem District, inform you that your building was built on an unregulated and open area according to Plan No. 2000 in Jerusalem. A building permit was requested on February 17th, 2009. It was rejected. An appeal was filed on July 16th, 2009. It was also rejected. As such, I conclude that:
  • The building was built without a proper legal permit.
  • The building was not finished as of February 22nd, 2010.
  • The building was not inhabited as of February 22nd, 2010.
On the 25th of February, 2010, the advocate Dani Horien filed a legal objection to the building in front of Daliet Zipler. This decision was issued as a result. The decision has my stamp and signature of approval.

The second order indicated the following:
 
Administrative Demolition Order
 
An administrative demolition order against the building established on land number 215050/627450 in the area of Al Walajeh is hereby issued. The building has an area of 109 m2 and is made of balconies and concrete.
 
The order is executable in one of the following cases:
  • If an additional building takes place within 24 hours, and in 72 hours in all cases.
  • In accordance with Article 250 of the Building and Organization Law of 1965.
