Description:
Thursday, August 5th 2021, The Israeli Occupation demolished two houses, and issued a demolition notice for a third on the pretext of building without a license in Sa’ir town east Hebron.
About 7:00 am, a massive army force, accompanied by the building and organization officers at the civil administration and Hyundai excavators raided Wad Ash-Sharq area west the town.
The Occupation Forces reached houses of citizens from Jardat family, encircled the location and told the owners that they will carry out the demolition.

The targeted houses belong to:
- Citizen Hayel Jaradat: The Occupation demolished his house, which consists of 3 floors, with a total area of 400 m2, built of stones and concrete, and still under construction, the house was supposed to be a home for a family of 6, 4 of them are children.
The Occupation demolished a cistern below the house, that has a storage capacity of (160 m3) and a cement wall about 50 m*1.5 m high.
Affected citizen Continued the construction works at his house in 2017, the constructions cost 400 thousand shekels (about 120 thousand dollars).
- Citizen Khaleel Jaradat: The Occupation demolished his house, which consists of 3 floors, with a total area of 400 m2, built of stones and concrete, and still under construction, in addition to a 150 m3 storage cistern below the house.
The targeted house was under construction and was supposed to be a home for a family of 4, 2 of them are children.

In March 24th 2019, the Israeli Occupation issued halt of work notices, on the pretext of building without a license, citizens then prepared a legal file and hired a lawyer for the case, but the Occupation Authorities refuses to provide licenses for Palestinians and at the end they demolish their houses and facilities.

The Occupation Authorities also served a halt of work notice for a house that belongs to ‘Ali Jaradat (father of Hayel and Khaleel).

The notice ordered the immediate stoppage of construction works on the pretext of building without a license, and sat September 1st 2021 as the date of the subcommittee session in Beit El military court to decide the fate of the structure.
The house composes of 3 floors, has a total area of 400 m2 that Is still on the final phase of construction, and was supposed to be a home for family of Jardat and his wife.
Legal Commentary:
The demolition of Palestinian homes and installations by the occupation authorities is part of their violations of international and humanitarian law, and the violation of the right to adequate housing for Palestinian citizens guaranteed by international law and international treaties presented by the following articles:
Article 53 of the Fourth Geneva Convention of 1948 prohibits the destruction of property, as this article states the following: “The occupying power is prohibited from destroying any private, fixed or movable property related to individuals or groups, the state or public authorities, or social or cooperative organizations, unless the war operations inevitably require this destruction.
Article 33 of the Fourth Geneva Convention states: “No protected person may be punished for an offense he or she has not personally committed.
Paragraph ‘g’ of Article 23 of the Hague Convention of 1907 AD also warned against destroying or seizing the enemy’s property, unless the necessities of war necessarily require such destruction or seizure.
Article 17 of the Universal Declaration of Human Rights, dated December 10, 1948 states that “No one shall be arbitrarily deprived of his property”.
