Stop-work Orders for 11 Structures in Wadi al Nis

Violation: stop-work orders for 9 structures and 2 water cisterns

Details:

On September  30, 2014, Israeli troops accompanied by officers of the so-called Higher Organization Council broke into Wadi al Nis village and handed the locals 11 stop-work order. The orders, entitled 'stop-work orders' were issued by the Higher Organization Council under  the pretext of unlicensed construction in area classified 'C' according to Oslo Accords.

The military orders gave residents a 12 day  objection period  and to be prepared for the so-called Inspection Sub-Committee session in the court of Beit El to consider whether to demolish the structure or restore its status quo.

The notified structures belong to the following :

  1. The residence of Nasri Abu Hammad: it is still under construction and is of 200m2 in area.  The house is supposed to be home for the owner's  five member family including three minors. Noteworthy, this is the second time the house got notified.
  2. The residence of Iysa  Abu Hammad: it is still under construction and is of 70m2 in area.  The house is supposed to be home for the owner's eight  member family including six minors.
  3. The residence of Hasan Abu Hammad: it is an uninhabited two story house with a total area of 220m2. The house is intended to be home for the owner's 7 member family including five minors. Noteworthy, this is the second time the house got notified
  4. The residence of Anwar Abu Hammad:  it is of 140m2 and is inhabited by the owner's 6 family member including four minors. . Noteworthy, this is the second time the house got notified
  5. The residence of Osama Abu Hammad: it is of 150m2 in area in which he lives with his wife. . Noteworthy, this is the second time the house got notified.
  6. A structure belonging to Said Abu Hammad: it is composed of storehouses on which a second floor is founded. The building total area is 600m2. . Noteworthy, this is the second time the house got notified
  7. The residence of Ahmad Abu Hammad: it is a four story building with a total area of 700m2. Noteworthy , the first three floors are ready to be inhabited where the fourth is still under construction.

It should be mentioned that occupation military targeted the area of Wad al-Nis on 25/12/2014 where Israeli troops and a staff from the Planning Committee served five stop-work orders on residences.

It should be mentioned that the stop-work orders were issued by the Higher Organization Council under  the pretext of unlicensed construction , taking into consideration that the occupation put complicated procedures on Palestinian in the process of obtaining building permits.  According to a member of Wad al-Nis village council, Israel Civil Administration reported people that they will come back to serve more orders in the area. The affected families immediately sought help through legal defense to protect their residences and lands.

Not only that, the occupation has been targeting the Palestinian building movement in the area classified C, which is 62% of the West Bank lands according to Oslo Accords. Demographic expansion in addition to land use are banned for Palestinians in such areas.

Wadi al Nis:

The  village is located 6.8 km to the south of Bethlehem and is  surrounded by al-Rahma village fromor, the north, Um Salamona from the south and the area of Jurit al-Sham'a from the east; the colony of Eliezer is founded on lands confiscated from the village  western side.

 The village total land area is 10437 dunums of which 99  dunums are the built up area that is  inhabited by 1000 people who rely on agriculture and herding in their living.

The following colonies are located on Wad al-Nis village:

  • Eliezer: It was established in 1975 on about 492 confiscated dunums and is inhabited by 882 colonists.
  • Efrat: it was established in 1979 on about 2063 confiscated dunums and is inhabited by 7037 colonists.
  • Nevi Daniel: it was established in 1982 on about 549 confiscated dunums and is inhabited by 1073 colonists.

A vast area of lands was confiscated from Wad al-Nis in the process  of implementing the following colonial plans:

  • The bypass roads:  more than 484 dunums were confiscated for the favor of opening such roads.
  • The apartheid wall: it confiscated 1845 dunums as per its route that is of 18.451 meter in length .Noteworthy,  an area of 9431(90% of the village's total area) will be separated behind the wall after its completion

The Oslo Accords divided the lands of Wad al-Nis as follows:

  1. 111 (1% of the village's total area ) dunums were classified as area B, which is administratively under Palestinian sovereignty .
  2. 10.323 dunums were classified as area C (99% of the village's total area),which is under the full control ( administration and security) of Israel.
