The Occupation Demolishes an Agricultural Room in Idhna town / West Hebron

Description:

Tuseday , July 26th 2022 , the occupation auhorities demolished an agricultural room belongs to citizen ‘Issam Al-Tumaizy , on the pretext of building without a license in Idhna town , west Hebron.

Al-Tumaizy (37) said that a massive army force, the Israeli civil administration , and a bulldozer from the Israeli civil Administration raided “Wad ‘Aziz” west the town , and raided an agricultural land , and the bulldozers demolished the room.

Al-Tmaizy said that the occupation authorities demolished the room without halt of work and demolition notices , and was shocked of the occupation forces showing up and carrying out the demolition.

The demolished room is built of steal sheets , and has a total area of (25 m2) used by Tumaizy to live at it as they work in the plot , and to store agricultural and hand tools.

The affected citizen said that the occupation demolished the room and destroyed everything inside it , one of the properties is a water reservoir that was used for irrigation.

The town of Edhna :[1]

Edhna is located 18 km from the city of Hebron, with a total area of 26,152 dunums, of which 2,653 dunams are the built-up area of the village. The population of the town was 26,009 until 2017. The occupation confiscated 107 dunums of its lands in favor of the apartheid wall, which was ruined under its path. It also isolated 3,511 dunums behind it. The bypass road No. 35, whose length is on the lands of Ethna (4,674 m), which was looted from the lands of the village reached about 467 dunums.

Legal Commentary:

The demolition of Palestinian structure by the occupation authorities is part of their violations of international and humanitarian law, and the violation of the right to adequate housing for Palestinian citizens guaranteed by international law and international treaties presented by the following articles:

Article 17 of the Universal Declaration of Human Rights, dated December 10, 1948 states that “No one shall be arbitrarily deprived of his property”.

Article 53 of the Fourth Geneva Convention of 1948 prohibits the destruction of property, as this article states the following: “The occupying power is prohibited from destroying any private, fixed or movable property related to individuals or groups, the state or public authorities, or social or cooperative organizations, unless the war operations inevitably require this destruction.

Article 33 of the Fourth Geneva Convention states: “No protected person may be punished for an offense he or she has not personally committed.

Paragraph ‘g’ of Article 23 of the Hague Convention of 1907 AD also warned against destroying or seizing the enemy’s property, unless the necessities of war necessarily require such destruction or seizure.
