Description:

Monday, August 23rd 2021, the Israeli Occupation Authorities served halt of work notices for structures on the pretext of building without a license.

  • Halt of Work notices:

The building inspector at the Civil Administration raided the northern neighborhood of “Al-Marehat” area and targeted many structures with halt of work military orders on the pretext of building without a license.

According to the notices, the occupation sat September 1st 2021, as the date of the subcommittee session in Beit El military court to decide the fate of the structures.

Affected Citizen Fayez Abdeldayim told LRC:

“I own a plot in Al-Marehat area that I cultivate regularly. two years ago, a group of colonists established an outpost on Salfit lands at Ar-Ras area, the outpost is 80 m away from my land, and since that day we’ve been witnessing daily assaults by colonists, and today the occupation issued a halt of work order for a structure in my plot , and at the same time the occupation government allowed the expansion of a new outpost.”

  • Eviction notice for a plot:

August 23rd 2021, the building inspector at the Israeli Civil Administration gave farmer Wael Al-Khafsh (56) an eviction military order to return the plot to its previous status in (45 days) on the pretext that the plot is an Israeli state property.

According to the map attached to military order (001015), The targeted plot is in Ak-Marhat area north Salfit city, and the occupation gave the affected three copies of the notice.

Affected Citizen pointed out:

“I own a plot with a total area of three dunums, and at early May , I carried on rehabilitating the plot through construction of retaining walls and setting up a metal siege, but the occupation still had issued an eviction order for the plot.” Noteworthy, the owner supports a family of six people, 3 of them are children.

Legal Feedback:

The Israeli Occupation carries out Constant Human Rights Violations against Palestinians, including:

Hague Convention/ 1907:

  • 46. Private property cannot be confiscated.
  • 55. The occupying State shall be regarded only as administrator and usufructuary of public buildings, real estate, forests, and agricultural estates belonging to the hostile State, and situated in the occupied country. It must safeguard the capital of these properties, and administer them in accordance with the rules of usufruct.

Geneva fourth Convention/1949:

  • Article 53 prohibits the destruction of property, as this article states the following: “The occupying power is prohibited from destroying any private, fixed or movable property related to individuals or groups, the state or public authorities, or social or cooperative organizations, unless the war operations inevitably require this destruction.
  • Article 147 of Geneva fourth convention: extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)
