The Israeli occupation demolish a house Al-Hijra village / south Hebron

Description:

Wednesday, September 25th 2019, the Israeli occupation authorities demolished a house belongs to Sameer Doudin in Al-Hijra, on the pretext of building without licenses.

An army force and a vehicle from the building and organization department in the civil administration accompanied by a  “KUMATSU” excavator and a “VOLVO” from the Israeli occupation civil administration, and surrounded the area then demolished the house.

The Israeli occupation municipality demolished a house in the southern area of Al-Hijra, to the south of (bypass 60). The targeted house has a total area of (550 m2) and consists of two floors built of stones and strengthened cement , the owner commenced construction works since 2015, and still under construction, it was supposed to be a home for a family of 5 , 3 of them are children.

Affected citizen said that he received a halt of work order from the Israeli occupation building and organization department, on the pretext of building without licenses. However, the owner prepared a legal file  and proved he owns the plot where the house is built , and filed it to the civil administration , he also hired a lawyer to file an appeal and follow up the case.

According to Doudin’s lawyer, the owner fulfilled the conditions for licensing application, but that did not stop the occupation authorities from rejecting to license the structures , in 29/08/2019, Doudin’s lawyer filed a petition to the Israeli supreme court, and before announcing their decision , the occupation machineries showed up and demolished the external walls of the house.

The owner who works as a teacher in a public school said that the house caused about 800,000 NIS (about 230,000 $).

Notice

After one day, the occupation authorities came back with two excavators, one of them was produced by “KUMATSU” and the other by “LIUGONG” and completely leveled the structures to the ground , see the pictures.

Al-Hijra is part of Dura city , and has an area of 40,904 dunums, Al-Hijra has a built up area of 168 dunums , and located to the south of Dura, and bordered by bypass 60 on the south.

International Conventions and agreements pertaining to house and residents demolition:

Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)

Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.

Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.

Article 32 of Hague convention 1907 part g: To destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war.

Article 17 of Universal declaration of human rights 10Dec- 1948:  No one shall be arbitrarily deprived of his property.
