Description:

January 23, The Israeli occupation forces ravaged lands and demolished retaining walls of a plot owned by farmers Said Abu Hadid and Ratib Ar-Rajabi.

8:00 in the morning, Israeli occupation troops and their machines raided Wadi Al-Samin village south-west Hebron; the troops encircled an 8 dunums plot and carried on ravaging soil and destroying retaining walls, the used machineries are (2 diggers (Hyundai) and a bulldozer (caterpillar)) .

The targeted plot (8 dunums) belongs to farmers Said Abu Hadid and Ratib AR-Rajabi, the farmers constructed a retaining wall leveling to place greenhouses in the land.

However, in November 22 -2018, the occupation authorities issued an eviction military order targeting the plot, claiming that the property is under the Israeli state custody,  the military order (45357) was placed in the land and said that the owners have to vacate the plot within 45 days.

Farmer Ratib Al-Rajabi assigned a human rights institution to object on the order in the Israeli court, but the occupation authorities refused the objection and destroyed the agricultural land.

Legal Feedback:

The con-stringing policy  by the Israeli occupation authorities   of confiscating Palestinian can only be regarded as a violation of all  international conventions  and agreements like:

The International Covenant on Civil and Political Rights:

  1. All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence.

Geneve forth convention 1949:

Article 55: Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited.

Article 174:  taking of hostages and extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly.

Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)

Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
